Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Adapted Study LLC ("Adapted Study," "we," "us," or "our") governing your use of adapted.study and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. U.S. users; foreign frameworks disclaimed

The Service is designed and intended for users in the United States. Adapted Study is a Texas limited liability company. We do not represent that the Service complies with the GDPR, UK GDPR, or other non-U.S. regulatory frameworks. If you use the Service from outside the United States, you do so at your own initiative and are responsible for compliance with local law.

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you confirm that you meet this requirement and have the legal capacity to enter this agreement.

3. Accounts and Google Sign-In

You are responsible for your account credentials and for activity under your account. If you use Google Sign-In, Google's terms also apply to your use of Google's authentication. Our handling of Google user data is described in the Privacy Policy.

4. Your content

You retain ownership of study materials you upload. You grant Adapted Study a limited license to host, process, transform, and display that content solely to provide and improve the Service. You represent that you have the rights needed to upload and use the content in this way. Do not upload unlawful material or material that infringes others' rights.

5. AI-generated content

Study guides, quizzes, tutor responses, oral feedback, and similar outputs may be generated by artificial intelligence and grounded in your uploads. AI can be incomplete or incorrect. You are responsible for verifying critical information against authoritative sources. Adapted Study does not guarantee exam outcomes or the accuracy of any AI output.

6. Not legal advice

The founder of Adapted Study is a licensed attorney in the State of Texas. Nothing provided by, through, or in association with Adapted Study - including the website, the product, emails, Founder's Circle conversations, or other communications - is legal advice. No attorney-client relationship is created by using the Service or speaking with the founder through Adapted Study. If you need legal advice, consult an attorney licensed in your jurisdiction under a separate professional engagement.

7. Not medical advice; accommodations

The Service provides educational tools and accessibility/accommodation features. It does not diagnose, treat, or cure dyslexia, ADHD, or any medical or psychological condition. It is not a medical device and is not a substitute for professional care.

8. No affiliation with agencies or exam vendors

Adapted Study is not affiliated with, endorsed by, or an official provider for any law enforcement agency, governmental body, testing vendor, or exam publisher. Practice materials come from what you upload or from content we clearly identify. Do not treat the Service as an official exam or agency publication.

9. Plans, Foundation tier, and add-ons

The Foundation tier is free and includes essential accessibility and accommodation features. Paid tiers differ primarily by study volume and capacity. Optional premium add-ons may offer upgraded technology that can be more enjoyable to use; essentials remain available on Foundation. Higher paid tiers may include some or all premium add-ons as a bonus. Subscriptions are billed through Stripe and may be canceled according to the billing portal and applicable plan terms. Except where required by law or expressly stated in writing, fees are non-refundable for the current billing period.

10. Founder's Circle

Founder's Circle is a limited, inquire-only early adopter tier with greater access to the founder and influence on the future of the Service. It may include Unlimited study volume, premium add-ons as a bonus, and limited scheduled time with the founder for educational coaching (for example, oral presentation feedback or study strategy discussion). Founder time is not legal advice and does not create an attorney-client relationship. Seat availability is limited.

Conditional Readiness Guarantee

Founder's Circle includes a Conditional Readiness Guarantee. When the study-path conditions are met as described in Founder's Circle information and communications and you document that you did not pass within thirty days of the exam, Adapted Study provides free continued access until your next attempt. This is a free-repeat form of continued access - not a cash refund and not a guarantee of exam passage. Claims are reviewed against the study-path conditions above.

11. Acceptable use

We may suspend or terminate access for violations of these Terms or to protect the Service and other users.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAPTED STUDY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE NOT PAID US). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Indemnity

You will defend and indemnify Adapted Study LLC against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles that would apply the law of another jurisdiction.

16. Venue and forum

Exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Service lie in the state courts located in Bexar County, Texas, or in the United States District Court for the Western District of Texas, San Antonio Division, as applicable. You consent to personal jurisdiction in those courts.

17. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms.
